Barradale, O’Connell, Newkirk & Dwyer P.A. was established in 2005 to provide a complete range of services to help clients manage the transfer of their wealth. Whether your estate is large or small, simple or complex, we work with our clients to devise a solution that meets their needs. Our team of attorneys has experience in the areas of estate planning, small business succession planning, estate and trust administration, charitable planning, guardianship, elder law, and gift, estate and generation skipping transfer tax planning. We also assist our clients with disputes regarding the administration of estates, trusts and guardianships, through settlement, mediation and if necessary, litigation.

Two of our four founders, David Barradale and Maureen Dwyer, retired in 2018. Colleen O’Connell and Pamela Newkirk continue the firm’s commitment to our clients with the assistance of Attorneys Laura Tetrault and Tara Richard. Areas of Practice


Taking care of your loved ones includes expressing your final wishes clearly so that they know what you want even when you are unable to tell them.  We assist our clients in expressing those wishes with their wills, trusts, powers of attorney and living wills.

Elder Law, Medicaid Planning AND Enrollment

Planning for your long-term care can seem overwhelming.  We assist our clients by advising them of the opportunities available to preserve their assets, the restrictions on the preservation of assets, and the status of the laws governing Medicaid eligibility.  We also help our clients process Medicaid applications when it is time to enroll.

Tax Planning and Business Succession planning

The tax laws now provide great opportunity for the transfer of wealth during our lifetimes and thereafter.  We assist our clients by advising them how to take advantage of those opportunities to meet their goals and wishes presently and towards the future.


Sometimes, despite all efforts, issues arise between the heirs of an incapacitated person or decedent.  When this happens, we assist our clients in resolving those issues through mediation and settlement if possible, or through the courts if necessary.


New Hampshire is a leader in establishing laws to make it easier to administer estates and trusts in a manner faithful to the wishes of trust settlors.  We assist clients in the administration of estates through the probate court, and the administration of trusts to ensure that those wishes are carried out.

A durable power of attorney for healthcare does not cover all of the matters that may arise when someone becomes incapacitated.  In those cases, or when someone doesn’t have a power of attorney in place before they become incapacitated, a guardianship may become necessary.  We assist clients in seeking guardianship and administering the guardianship after a guardian is appointed.
